ANALISIS YURIDIS PERBANDINGAN KEDUDUKAN HUKUM ADAT DAN HUKUM INTERNASIONAL DALAM SISTEM HUKUM NASIONAL INDONESIA

This study aims to conduct a comparative juridical analysis of the position of customary law and international law within the Indonesian national legal system. The focus of the study is to examine the recognition, hierarchical placement, and dynamics of interaction and potential conflicts between the two legal systems and national positive law. The research method used is normative juridical with a statutory, comparative, and conceptual approach. Data are sourced from primary legal materials (the 1945 Constitution of the Republic of Indonesia, related laws) and secondary legal materials (doctrines, literature) which are analyzed qualitatively to obtain a systematic interpretation. The results of the study indicate that customary law has constitutional recognition (Article 18B paragraph 2 of the 1945 Constitution) as a conditional living law, but in practice it is often subordinated to written law. On the other hand, international law (especially treaties) tends to adhere to the theory of dualism, which requires transformation through ratification (Law/Presidential Decree) in order to be binding domestically. Comparatively, customary law is an internal-historical source of law, while international law is an external-political source. Although both are recognized, the enforcement mechanisms and legal force of both are fundamentally different in the national legal system.
